India: High court dismisses plea for gay marriage

Even though India finally decriminalized gay sex in 2018, many LGBT+ people still experience numerous forms of discrimination on a daily basis. On Monday July 9th, The Delhi High Court turned down an appeal for marriage equality.

The Delhi High Court was requested to change the current laws regarding marriage and adoption rights for couples of the same sex. Tajinder Singh led the petition for the plea and said: “the constitution treats everyone equally without any discrimination. It is the duty of the state to ensure that no one should be discriminated.”

Unfortunately the High Court rejected the plea and said that they are not in the position to draft such laws. According to the High Court, it is up the parliament of India to draft and pass laws. Also, the High Court claims that they are not able to direct parliament into drafting laws. The High Court refused to form a commission on the issue as well.

While gay sex was finally legalized in the country last year, the LGBT+ community in India is still unprotected without an anti-discrimination legislation. Besides the lack of marriage equality, many LGBT+ people still face many forms of discrimination on a daily basis.
